make any warranties, express or implied, including without limitation, those of
merchantability and fitness for a particular purpose, with respect to
CareerBoard.com or any information or goods that are available on, or
advertised or sold through, CareerBoard.com. We do not make any
representations, nor do we endorse the accuracy, completeness, timeliness or
reliability of any advice, opinion, statement or other material or database

links from CareerBoard.com. We reserve the right to correct any errors or

feature of the data). You agree to indemnify and hold harmless us, our
directors, officers, shareholders, parents, subsidiaries, affiliates, agents,
and licensers, from and against all losses, expenses, damages and costs,
including reasonable attorneys' fees, resulting from your violation of the
Usage Rules, or the failure to fulfill any obligations relating to your account
incurred by you or any other person using your account. We reserve the right to
take over the exclusive defense of any claim for which we are entitled to
indemnification under this Section. In such event, you shall provide us with
such cooperation as is reasonably requested by us.
Posting Rules
You agree to abide by the following rules when posting material and content on
CareerBoard.com:
- When posting job opportunities, you will not post any messages or
materials anonymously or under a false name and you agree that you are
solely responsible for any statements that are posted using your account.
- You will not post or upload any material or links to material (including,
but not limited to text, content, photos, video, animation, graphics, audio,
or software) that is libelous, harassing, disruptive or a violation of
applicable law or that would constitute grounds for civil liability.
- Your postings in a particular category will be reasonably germane to that
topic.
- You will not post advertisements, chain letters, charity requests,
petitions for signatures, or any solicitation of other users that are
inappropriate.
- You will only post materials on CareerBoard.com for which you have
obtained appropriate copyright or other permission to upload such materials
and to permit downloading by other users for personal, noncommercial use.
- You will not violate, plagiarize, or infringe on the rights of third
parties, including, copyright, trademark, trade secret, privacy, personal,
publicity, or proprietary rights.
- You acknowledge that any materials you upload will be considered to be in
the public domain.
Questionable Materials
If you encounter questionable materials on CareerBoard.com, please contact us

YOUR REGISTRATION OBLIGATIONS
In consideration of your use of the Service, you represent that you are of
legal age to form a binding contract and are not a person barred from receiving
services under the laws of the United States or other applicable jurisdiction.
You also agree to: (a) provide true, accurate, current and complete information
about yourself as prompted by the Service's registration form and (b) maintain
and promptly update the Registration Data to keep it true, accurate, current
and complete. If you provide any information that is untrue, inaccurate, not
current or incomplete, or CareerBoard has reasonable grounds to suspect that
such information is untrue, inaccurate, not current or incomplete, CareerBoard
has the right to suspend or terminate your account and refuse any and all
current or future use of the Service (or any portion thereof). CareerBoard is
concerned about the safety and privacy of all its users, particularly children.
For this reason, by using the site, you are verifying that you are of legal
working age as dictated by the laws of the United State of America.
MEMBER ACCOUNT, PASSWORD AND SECURITY
You will receive a password and account designation upon completing
CareerBoard's registration process. You are responsible for maintaining the
confidentiality of the password and account, and are fully responsible for all
activities that occur under your password or account. You agree to (a)
immediately notify CareerBoard of any unauthorized use of your password or
account or any other breach of security, and (b) ensure that you exit from your
account at the end of each session. CareerBoard cannot and will not be liable
for any loss or damage arising from your failure to comply with this rule.
Limit On Our Liability
CareerBoard.com, its officers, directors, shareholders, parents, subsidiaries,
affiliates, agents, or licensers are not liable for incidental, indirect,
consequential, special, punitive, or exemplary damages of any kind, including
lost revenues or profits, loss of business or loss of data, in any way related
to this service or for any claim, loss or injury based on errors or omission,
interruptions or any other inaccuracies appearing on CareerBoard.com (including
without limitation as a result of breach of any warranty or other term of this
Agreement). Any claim against us shall be limited to the amount you paid, if
any, to us for use of CareerBoard.com.
DAMAGE LIMITATIONS AND EQUITABLE RELIEF
(a) YOU ASSUME ALL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SITE, THE
INTERNET GENERALLY, AND THE DOCUMENTS YOU POST OR ACCESS AND FOR YOUR CONDUCT
ON AND OFF THE SITE.
(b) IN NO EVENT SHALL CAREERBOARD (OR ANY OF ITS OFFICERS, DIRECTORS,
SHAREHOLDERS, EMPLOYEES, AFFILIATES, AGENTS OR ADVERTISERS), BE LIABLE FOR ANY
NON-DIRECT DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND
CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST
EMPLOYMENT OPPORTUNITY, OR BUSINESS INTERRUPTION) RESULTING FROM OR ARISING
UNDER OR IN CONNECTION WITH THE USE OR ACCESS TO, OR THE INABILITY TO USE OR
ACCESS, THE SITE AND/OR ANY DOCUMENT, WHETHER BASED ON WARRANTY, CONTRACT,
TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT CAREERBOARD IS ADVISED OF
THE POSSIBILITY OF SUCH DAMAGES.
(c) CAREERBOARD DOES NOT GUARANTEE RESULTS AND DOES NOT GIVE REFUNDS ON ANY OF
ITS PRODUCTS AND/OR SERVICES FOR ANY REASON.
(d) Due to the nature of these Terms and Conditions, in addition to money
damages, CareerBoard will be entitled to equitable relief upon a breach of
these Terms and Conditions by you.
Future Access - Visitors
WE MAY, IN OUR SOLE DISCRETION, TERMINATE OR SUSPEND YOUR ACCESS TO ALL OR PART
OF THIS SERVICE FOR ANY REASON, INCLUDING FAILURE TO COMPLY WITH THESE USAGE
RULES. Access to CareerBoard.com is currently free. We reserve the right to
charge for such access in the future, to change the Usage Rules or to modify
any features of CareerBoard.com at any time.
Future Access - Employers
WE MAY, IN OUR SOLE DISCRETION, TERMINATE OR SUSPEND YOUR ACCESS TO ALL OR PART
OF THIS SERVICE FOR ANY REASON, INCLUDING FAILURE TO COMPLY WITH THESE USAGE
RULES. Employer/recruiter access to CareerBoard.com is currently a fee-based
service. We reserve the right to change our pricing structure for such access
at any time, to change the Usage Rules or to modify any features of
CareerBoard.com at any time. Please post only real jobs and resumes. Job
postings must be individual openings for traditional, W-2 or 1099 employees.
Other postings that CareerBoard does not support include, but are not limited
to:
- Positions that require a monetary investment by the job seeker at any time
- Advertisements for Multi-Level Marketing (MLM) positions
- Business opportunities, including Email Processors and Project 21
- Anything related to the adult entertainment industry
All information contained in postings must be clear and accurate, not
misleading in any way, containing sufficient detail. Postings which require a
user to "email for more details" or supply a Social Security number
are not supported.
Payment of Services upon Termination
If at any time during the course of this agreement you should terminate this
Agreement, not to include your termination in the case of breach of this
agreement by CareerBoard, CareerBoard shall reserve the right to receive all
payments from you of the services used by you up to termination.
Governing Law
The Usage Rules shall be governed by the laws of the United States of America
and the State of Ohio.
BY CONTINUING TO USE CAREERBOARD.COM, YOU AGREE TO ABIDE BY THE TERMS OF THE
